For many, family law is thought to be synonymous with divorce proceedings. In reality, divorce is just one part of family law which covers a broad array of domestic issues including adoption, premarital agreements, paternity and child support issues. At HMA Law, we focus on prenuptial and marital agreements because it is not enough for an attorney drafting these agreements to have a solid knowledge of California community property and family law. The attorney needs expertise in estate planning as well. We are one of the few firms that can bring together these different areas to craft an effective prenuptial or marital agreement.

Prenuptial & Marital Agreements

Prenuptial agreements are essential to your estate planning. They also make a lot of sense. Expect the best, but plan for the worst. Think of your impending marriage as a long term project. e.g. the scaling of Mount Everest. Would you seek to scale Everest without having a contingency plan? Of course not! Similarly, a prenup is your contingency plan prior to embarking on a marriage. in these times, where nearly one in two marriages comes apart, it is foolish to embark on a marriage without having a well-crafted prenuptial agreement signed way in advance, preferably several months in advance of the marriage. At HMA Law we can assist you with drafting a prenup that meets your needs. You should, along with your intended, sign the agreement as far in advance of the wedding as possible. At HMA Law, we will not draft, review or support any agreement unless it is signed at least two months in advance of the date of marriage. The other key to a successful prenuptial agreement is to be represented by independent counsel, and have both independent counsel certify the document.

At HMA Law we will not undertake drafting a prenuptial agreement unless your intended has independent legal counsel. Marital agreements work in much the same way and need similar safeguards in terms of independent representation by counsel. HMA stands ready to assist with marital agreements as well.
